  • ActionSA demands for the closure of beaches in Durban

    The ActionSA in KwaZulu-Natal has demanded that the eThekwini Municipality close all beaches in response to recent drowning accidents that claimed three lives and wounded seventeen others.

    Mzwakele Mncwango, provincial chair of ActionSA in KwaZulu-Natal, issued the following statement on Wednesday: “ActionSA calls on the eThekwini Metro Municipality to close all beaches pending an investigation into the recent drownings at North Beach, which resulted in the deaths of three people and the injuries of seventeen others.

    “While we do not want lifeguards to lose their employment or those whose lives depend on the opening of beaches to be left without a source of income, ActionSA thinks that preventative steps should have been taken to prevent the catastrophe. Unfortunately, the municipality failed to implement these steps.”

    According to Mncwango, the eThekwini Municipality is in possession of a report that indicates the irregular appointment of the service provider engaged by the municipality to teach lifeguards: Lifesaving South Africa.
    Mncwango stated that Lifesaving South Africa’s lifeguarding certificates do not meet the required compliance standards.

    “The City’s Integrity & Investigation Unit received an anonymous complaint alleging irregular appointment of a service provider, Lifesaving South Africa, a Non-Profit Organization (NPO) used by the Municipality to teach lifeguards, according to a report that was leaked. The NPO was not certified by the South African Qualifications Authority (SAQA), Health & Welfare Sector Education and Training Authority (HWSETA), or the Department of Labour.

    “The report determined that the lifeguard credentials provided by Lifesaving SA do not meet the Department of Labor’s requirements and should thus be deemed invalid. The report suggested selecting an authorized service provider. “It is clear from these latest discoveries that incompetence runs deep in the eThekwini Municipality,” he remarked.
    According to Mncwango, the eThekwini municipality did not adhere to its own guidelines, and ActionSA urges firmly for the closure of all beaches until an investigation.

    “ActionSA will work tirelessly to eradicate municipal incompetence in an effort to combat the unscrupulous leadership that has brought the city to its knees,”

  • “Ramaphosa continues to face criminal charges” – Foundation Zuma

    The Jacob Zuma foundation criticized the National Prosecuting Authority’s (NPA) declaration recusing President Cyril Ramaphosa from the Zuma vs. Karyn Maughan and Billy Downer case.

    Last week on Thursday, Zuma initiated a private prosecution against Ramaphosa. The foundation stated that the former president is suing his successor in respect to his lawsuit against state prosecutor Downer and journalist Maughan of Media24, whom he accuses of improperly leaking his medical records.

    In his corruption case, the foundation stated that Ramaphosa was “an accessory after the fact to offences perpetrated by, among others, advocate Downer, including breaking the terms of the NPA Act.”

    The Presidency, however, rejected the allegations, arguing that Zuma is misusing judicial processes and that the charges are “frivolous and unsubstantiated.”

    “According to the Criminal Procedure Act, a private prosecution can only be initiated when the prosecutor obtains a certificate of non-prosecution,” the Presidency said on Friday.

    “The certificate serves as legal proof that the NPA will not pursue prosecution after reviewing the accusations.”

    “Mr. Zuma has not produced such a certificate with allegations in the name of President Ramaphosa. The summons sent to the president is inexcusably deficient and indicates blatant disrespect for the law.”

    In a statement released on Wednesday, the NPA stated that the nolle prosequi certificate on which Zuma relies includes everyone listed in the affidavits and declarations in the case other than Ramaphosa.

    The head of the National Prosecution Services, Rodney De Kock, stated, “As background, the NPA issued two nolle prosequi certificates in good faith and in accordance with Section 7 of the Criminal Procedure Act. These certifications were given in direct reference to the docket (Pietermaritzburg CAS 309/10/21) which contained statements and affidavits pertaining to particular individuals for alleged violations of Section 41 (6) and Section 41(7) of the NPA Act.

    “The nolle certificates are applicable to all parties properly named in the docket. The president was not mentioned in any of the affidavits or declarations, hence no certificates were given in his name.”

    According to Zwanele Manyi, spokeswoman for the JG Foundation, the NPA is taking sides by attempting to rescue the president.

    “The foundation rejects with the disdain it deserves the unethical and unprofessional attempt by the NPA to interpret its own certificate, which is the topic of a disagreement between a private prosecutor and an accused individual. This is really unprecedented. This patently incorrect remark is nothing more than a poorly veiled attempt to save Mr. Ramaphosa.

    “Paragraph 17 of the relevant affidavit reads: ‘The alleged behavior is also the subject of separate procedures being handled by the president of the Republic, Mr. Cyril Ramaphosa…’

    The relevant complaint letter made to President Ramaphosa and his response are included in the application I submitted to supplement my plea in any criminal proceeding.

    “It is simply beyond comprehension how any NPA member who has seen the docket could even begin to falsely assert that the president is not referenced in the docket. Even if the denial were accurate, it would be unacceptable for the NPA to take such an obvious stance on favor of a criminal suspect,” Manyi remarked.
    According to Mnayi, the NPA must decide if it would prosecute the president or not; otherwise, it must remain out of the conflict between the previous president and his successor.

    “We challenge the National Prosecuting Authority to tell the nation definitively if it is prepared to prosecute Mr. Ramaphosa as an accessory after the fact for the offenses alleged in the police complaint. If this is the case, the private prosecution must be terminated. In the event that this is not the case, it will be compelled to provide a certificate to that effect, which will leave us in the same position as before. This demonstrates the futility of the National Prosecutor’s Office’s (NPA) intervention, which is a further misuse of state resources, as exemplified by the state attorney and the spokesperson for the president.

    “The NPA must keep out of this disagreement and defer to the courts’ assessment of what the NPA intended to communicate when it used language such as “any individual” and “in connection with the matter.” In this perspective, subjective statements are worthless,” he stated.

    According to Manyi, Ramaphosa is still facing criminal charges and is scheduled to appear in court on January 19.

    “Mr. Ramaphosa remains legally charged and is scheduled to appear in person before the Johannesburg High Court on January 19, 2023 at 9:30 a.m.”

    Sally Tindall, head of research at RateCity.com.au, advises people to be particularly careful with their finances during the holidays.

    Scammers don’t take vacations, so even while it’s a fantastic time to kick back and relax, folks should be vigilant regarding scams.

    “Think before you send a text message, email, or social media post,” she advises.

    Australians who are interested in Boxing Day bargains should also be mindful of who they provide their financial information to.

    Ms. Tindall explains, “The post-Christmas sales can be a terrific time to score a deal, but it’s also an ideal time for con artists to take advantage of people.”

    “Assume nothing when shopping online.” Is it a site that I know and trust? Is the method of payment secure? Is the website requesting unnecessary personal or financial information?

    “If something seems suspect, close your browser and exit the site.”

    ‘Regularly review your bank statements and report any unusual transactions. Frequently, it’s just a store with an unusual name, but it’s preferable to feel momentarily foolish for questioning it than to risk losing thousands of dollars.

    A Christmas Grinch who stole a woman’s Boohoo package after she left it beneath a wheelie bin outside her front door was seen on surveillance footage last week perpetrating the theft.

    Recovery practitioner Nikola Howell from Fulbourne Road, Walthamstow, London, shared surveillance footage of a man in all-black entering her yard and removing the item seconds afterwards.

    Ms. Howell was assisting her stepfather at the time the gift was delivered and was expecting it for her mother, who was hospitalized with kidney difficulties.

    It comes after Labour MP Carolyn Harris criticized Evri last week, stating that families were enduring “Christmas anguish” due to the company losing or delaying delivery.

    The Evri courier dragged one of Ms. Howell’s wheelie bins across the yard before concealing the item underneath it.

    Footage reveals the Evri delivery man passing past the front gate and immediately bringing a wheelie bin across the front yard to the front door, where he conceals the gift beneath it.

    The delivery contained four things costing £35, including trousers, a sweater, and two shirts.

    Throughout the duration of the film, the delivery driver never knocked or rang the doorbell, and he left as swiftly as he arrived.

    Moments later, though, a second man enters the yard and removes the package from behind the trash can.

    Ms. Howell states that her Evri account indicated that the package was delivered just after 9 p.m., despite the fact that she was at home at the time.

    Ms. Howell criticized the courier for placing the trash can in front of her door, stating that it made her residence a “target.”

    Minutes after the delivery, the robber approached Ms. Howell’s front door while wearing a hooded coat to conceal his identity.

    After leaving Ms. Howell’s property, the man carried the package down the road as if it were his own.

    Ms. Howell reported on her CCTV tape how the man was ‘concealing his identity’ and appeared to know ‘just where to find the parcel.’

    She further explained that Evri did not mark the box as delivered until hours after it was stolen.

    In recent weeks, Evri, formerly known as Hermes, has received harsh online criticism from customers.

    Last week, the Swansea East Labour MP criticized the corporation.

    During a session of questions linked to the business of the Commons, Ms. Harris stated, “Many individuals across the United Kingdom are facing Christmas misery as a result of Evri’s delayed or lost online shopping deliveries.”

    “After voicing my concerns about this company on social media, I have been inundated with stories of late or lost packages, no or poor customer service, drivers earning less than the national living wage, drivers’ pay being withheld, and a pitiful gasoline allowance that is insufficient to cover increased fuel costs.

    A classic example of corporate avarice at the expense of employee wellbeing and customer service.

    After viewing the surveillance film, Ms. Howell called Boohoo and the courier Evri regarding the theft.

    Since then, Boohoo has reimbursed her order and given her a £15 coupon, while Evri has refunded her £30 as a “goodwill gesture” and contacted the local courier management.

    A representative for Evri stated, ‘We apologized to the customer and offered them a goodwill payment to cover the cost of the package.

    In addition, the sender has arranged for a refund.

    “We instruct our couriers on what constitutes a safe location, and we have followed up with the relevant courier.”

    Security and fraud prevention are taken very seriously by Evri.

    Callum was a 17-year-old A-level student of economics, philosophy, and politics when he decided to quit school to establish his own business.

    According to former employees, his brother Liam was the chief revenue officer and was rarely seen at the office. In a social media post, he was seen hooked up to a drip with the phrase, “What hangover?”

    Now, it appears that the brothers have fallen victim to yet another tech bubble, after a 300 percent increase in sales in 2021, driven by the removal of Covid limitations, gave investors maybe mistaken confidence.

    According to a presentation obtained by Insider, in April investors invested $150 million in Pollen, valuing the company at $800 million, and the company is aiming for $1 billion in gross bookings by 2023.

    Pollen filed into bankruptcy just four months later, despite generating $100 million in sales between September 2021 and March 2022, according to a Pollen spokesman.

    According to papers and staff and customer testimony, Pollen appears to have sustained long-term damage from a succession of cancelled events between 2020 and 2022, which caused its refunds and debts to venues to skyrocket. The company’s most recent public reports reveal a £30 million loss in 2020.

    Two months before filing for bankruptcy, the company allegedly spent £52,776 on a villa in Ibiza for 20 employees for eight weeks in May of this year. Callum’s expenditure report lists the apartment as ‘accommodation and entertainment for key clients,’ which Pollen claims was used “exclusively for work purposes.”

    A few days after the expense was incurred, his brother Liam wed his girlfriend on the Spanish party island.

    However, perhaps investors could have sounded the alarm after Pollen’s Departure Festival debacle in January of this year, just three months before to handing out $150 million.

    A Pollen spokesman told Insider that all 4,028 ticket purchasers received refunds, and that those who did not must have had a ‘problem on the customer’s side. They stated that Pollen incurred all expenses.

    Covid also cancelled Pollen’s Golden Sand festival in Mexico during the same month, which included 50 Cent, Fat Joe, and Lil’ Kim as headliners.

    A concert featuring reggaeton superstar J Balvin was postponed until June but ultimately canceled, as were 39 of the 360 concerts produced by Pollen in the preceding year.

    A Pollen official stated, “It is always a challenging choice to cancel one of our Experiences.” We never want to disappoint our consumers, the local community, or our business partners whose livelihoods would be affected by a cancellation.

    Bloomberg stated that since the outbreak of the pandemic, the company’s refund requests had cost them more than $75 million. By July, it owed the Grand Oasis Cancun and Las Vegas Hilton at Resorts World around $3.6 million and $1 million, respectively.

    Just weeks after obtaining $150 million in funding, Pollen eliminated over 200 positions. Experts in the tech industry speculated that the mass layoffs may have been a cost-cutting strategy proposed by investors as part of their agreement. The company had hired around 400 employees in total.

    In August, the company was served with a petition to dissolve.

    The order was issued by 101 Ways Limited’s creditors, according to the website of HM Tribunals. Pollen informed the Telegraph that the debt had been settled, and a court official confirmed that the petition was subsequently withdrawn.

    In the same month, an agency claimed on LinkedIn that Pollen owed it £24,000 after the company delayed its July payroll.

    In a statement released in August, the company explained: ‘Despite strong growth since Streetteam Software Ltd.’s inception eight years ago, the knock-on effects of COVID-19 over the last two years, which decimated much of the travel sector, together with the tech stock crash and current consumer uncertainty as a result of global economic conditions, put too much pressure on the business at a critical stage of a scale-maturity.’ up’s
